Employment Law

In the workplace problems can frequently arise when you need to seek specialist legal advice whether you are an Employer or an Employee. Our Employment Department is here to help.

As an employer you may need assistance with producing contracts of employment, policies and guidance, advice on procedures and best practice.

If the worst comes to the worst you may also need representation defending proceedings before the Employment Tribunal or Court.

As an employee you may need advice on your rights, assistance with negotiations or representation before the Employment Tribunal or Court.

We can provide specialist legal advice with experience of acting for employer and employee.

Employment Legislation is a complicated minefield of potential problems and can prove costly in both time and resources. Time limits are shorter than in most other fields of law, which can be fatal to your claim or defence to a claim.

Employees, generally, have only three months to bring their claim before the Employment Tribunal and employers only twenty-eight days to respond to a claim on receipt.

The Employment Tribunal has exclusive jurisdiction to deal with unfair dismissal claims including claims of Racial, Sexual, Age and Disability Discrimination where there is no limit on claims. The Tribunal can also award £25,000 for claims for Breach of Contract; claims over this amount will be brought before the High or County Court.

As an employee you may need advice on changes to your contract of employment, your rights to holidays, maternity or parental leave, and minimum wages.

You may need advice on responding to disciplinary proceedings or redundancy. You may feel you are being discriminated against or bullied due to your race, sex, age or as a result of disability. We can offer you specialist legal advice on your rights and how best to deal with these issues. If necessary we can submit your claim for compensation, deal with the procedural requirements and representation at the final hearing.

As an employer you may want advice at an early stage to avoid problems in the future.

Employment law is changing constantly. Failure to keep up to date can be very costly. Do all your employees have contracts? Are your policies and procedures up to date?

We can provide a “health check” on your current contracts and procedures, offering advice and guidance on specific situations including disciplinary or redundancy procedure. If an employee does issue proceedings we offer specialist advice, assistance and representation in defending those proceedings.

In most cases we offer a low cost 30 minute initial consultation and as an employee you may be eligible for free legal advice and assistance, so do not delay.
